Welcome to StackFetch (“we,” “us,” or “our”). These Terms of Service (these “Terms”) govern your access to and use of our website, web application, and any related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree with any part of these Terms, please do not use the Service.

1. Eligibility

You must be at least 18 years of age to use the Service.

By using the Service, you represent and warrant that you have the legal capacity and authority to enter into a binding agreement.

If you are accessing the Service from outside the United States, you are responsible for ensuring that your use of the Service is in compliance with all applicable local laws and regulations.

2. Description of the Service

StackFetch is a tool that allows you to search for online creators, influencers, or public individuals (collectively, “creators”) to view a generated “health stack.” This “health stack” compiles information from publicly available sources and third-party services (e.g., YouTube API, Google Custom Search API, Perplexity, OpenAI, Playwright, etc.). The information presented by the Service is for informational and entertainment purposes only and is not verified by any health or medical professional.

3. Accounts & User-Generated Content

No Registration Required: We do not currently offer or require user accounts. You may use the Service without creating an account.

No User-Generated Content (UGC): Our Service does not allow you to upload, post, or otherwise submit original content. Therefore, issues of ownership, moderation, and takedowns for UGC do not presently apply.

4. Intellectual Property

Our Content: All text, graphics, logos, designs, software, and other content available on or through the Service (excluding third-party content) are the property of StackFetch or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, and revocable license to use and access the Service for personal, non-commercial purposes.

Third-Party Content: We display or reference publicly available materials (e.g., profile pictures, public social media data, search results) from third parties (e.g., YouTube, Instagram, TikTok, X, Google Search). Your use of such content may be subject to the terms and licenses of the respective platforms or owners. We do not guarantee the right to reproduce or redistribute any third-party content.

Feedback: If you submit suggestions or feedback regarding the Service, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use and incorporate such feedback for any purpose without any obligation to you.

5. User Conduct

By using the Service, you agree that you will not:

  • Use the Service in any way that violates any applicable law or regulation.
  • Attempt to interfere with, disrupt, or circumvent the Service's security features, rate-limiting features, or other measures we may use to prevent unauthorized access.
  • Engage in any activity that compromises the stability or integrity of the Service, including uploading harmful or malicious code.
  • Misrepresent yourself, impersonate another individual or entity, or submit false information.

6. Disclaimer of Medical/Health Advice

The Service displays compiled information about a creator's public or rumored "health stack" (e.g., sleep, nutrition, movement routines). We are not medical professionals and do not guarantee the accuracy, completeness, or reliability of such information. Nothing provided by the Service should be interpreted as medical, health, or professional advice. Always consult a qualified professional for guidance tailored to your individual circumstances.

7. Disclaimer of Warranties

As-Is & As-Available: The Service is provided on an "as-is" and "as-available" basis, without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or that the results obtained from use of the Service will be accurate or reliable.

No Guarantee of Accuracy: We rely on third-party APIs and public data sources which may be inaccurate, outdated, or incomplete. We make no representations as to the correctness or reliability of the content displayed.

Use at Your Own Risk: Your use of the Service is at your own risk. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, StackFetch (including its officers, directors, employees, affiliates, and agents) shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of the Service, even if advised of the possibility of such damages.

In no event shall our total liability for all claims relating to the Service exceed the amount you paid to us (if any) in the twelve (12) months preceding the event giving rise to the claim or liability, or zero dollars if you have not paid us.

9. Indemnification

You agree to indemnify, defend, and hold harmless StackFetch, its officers, directors, employees, affiliates, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your misuse of the Service; or (c) your violation of any third-party rights, including intellectual property or privacy rights.

The Service may contain links or references to third-party websites, resources, or services. We do not endorse, control, or take responsibility for the content, privacy policies, or practices of any third parties.

Any interactions or transactions you have with third parties found through our Service are solely between you and the third party, and you agree that StackFetch is not liable for any loss or claim you may have against such third party.

11. Rate Limiting & IP Tracking

We implement rate limiting to prevent spam, abuse, or unauthorized access. This includes storing IP addresses for the sole purpose of managing request limits and ensuring Service stability. For more details on how we handle IP addresses and other data, please review our Privacy Policy.

12. Monetization & Affiliate Links

StackFetch participates in the Amazon Associates Program, an affiliate advertising program. When you click on Amazon affiliate links displayed on our Service and make a purchase, we earn a commission at no additional cost to you.

Our affiliate links (identified with tag=myfeeder-20 in the URL) are contextually relevant to the health stacks we document. These links provide a convenient way for users to purchase products that are mentioned in creators' health routines.

Affiliate Disclosure: As an Amazon Associate, StackFetch earns from qualifying purchases made through our affiliate links.

We may implement additional monetization strategies in the future. Any such changes will be reflected in updated Terms and/or our Privacy Policy.

13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of laws principles. Any dispute arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the state or federal courts located in California. You agree to submit to the personal jurisdiction of such courts and waive any objections to venue in those courts.

14. Termination

We reserve the right to suspend or terminate your access to the Service at any time and for any reason, including if we believe you have violated these Terms or engaged in conduct that could harm us or others. Upon termination, all licenses and rights granted to you in these Terms will immediately cease.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will post the revised Terms on the Service with a new "Effective Date." By continuing to use the Service after any such updates, you agree to be bound by the revised Terms.

16. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions.
